TSUCAVA provides nationwide mobile and online notary services, including document notarization, witness services, loan signing services, real estate closing assistance, and related communications. We facilitate both in‑person appointments and remote online notarization (“RON”) using audio‑visual technology. We also offer a client portal for real‑estate package orders, a blog with educational articles and news, and a newsletter subscription. From time to time we may offer additional services or features.

TSUCAVA is not a law firm and our notaries are not attorneys. We do not provide legal advice or representation. You are solely responsible for ensuring that documents meet legal requirements and that notarization is appropriate for your intended use.

Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms in full. If you do not accept these Terms, do not continue to use the Servicesmobilenotaryservicetx.com. Your continued use of the Services constitutes acceptance of any modifications we make to these Terms.

User Responsibilities

You agree to:

  1. Provide accurate information. When creating an account, placing an order or submitting any form, you must provide complete and accurate information. You must update your information promptly if it changes.

Account Registration and Security

Certain Services require registration of an account (e.g., client portal for real‑estate orders). You agree to maintain the confidentiality of your username and password and to restrict access to your account. You are responsible for any activities that occur under your account. If you believe your account has been compromised, you must notify us immediately.

We reserve the right to refuse or cancel your account or an Order if we determine, in our sole discretion, that you have violated these Terms or applicable law, or that your conduct is harmful to TSUCAVA or others.

Orders, Scheduling and Cancellations

Booking Services

You may book notary services via our website, through a partner portal (e.g., Title Loop) or by contacting us. When you place an Order, you agree to pay all fees and charges associated with the service. TSUCAVA will confirm availability of a notary and, once confirmed, will schedule the appointment and provide you with appointment details.

Document Uploads

Certain Services require you to upload documents for review prior to notarization. You are responsible for ensuring the accuracy, completeness and legibility of any document you upload. Uploaded files must conform to size and format limitations specified on the website. We may refuse to notarize documents that are illegible, incomplete or appear to be fraudulent.

Cancellations and Refunds

Appointments may be cancelled or rescheduled by contacting us. We require reasonable notice (e.g., at least two hours) prior to the scheduled appointment time. If you cancel within the required notice period, no cancellation fee will apply. If you cancel or reschedule on shorter notice or fail to appear for a scheduled appointment, you may be charged a cancellation fee or forfeit any deposit. Once notarization is completed, the service is considered rendered and no refund will be issuedamericannotarization.com.

No Legal Advice

Our Services are limited to acting as impartial witnesses for the signing of documents. We do not provide legal advice or representation. You should seek advice from an attorney or qualified professional for legal questions or document preparation.

Fees and Payment

Prices for Services are set forth on our website or will be provided upon request. Fees may vary depending on the type of notarization, location, time of appointment and other factors. You agree to pay all fees in full at the time of booking or as otherwise required. Taxes and government fees, if any, are your responsibility.

We reserve the right to modify our pricing at any time. Price changes will not affect Orders that have already been accepted. Payments are processed through trusted third‑party payment processors. We do not store your credit card details.

SMS Messaging Terms

By providing your mobile number and opting in to receive text messages from TSUCAVA, you consent to our sending you SMS messages for purposes such as account updates, appointment reminders, service notifications, promotions and other information related to your use of the Servicesamericannotarization.com. You acknowledge that message frequency may vary and that message and data rates imposed by your carrier may applyamericannotarization.com. You can opt out of promotional SMS at any time by replying “STOP” to any message or by contacting usamericannotarization.com.

We will strive to send SMS messages only as needed and in accordance with carrier guidelines. In no event shall our aggregate liability exceed the greater of (i) the amount you paid to us for the Services in the six months preceding the claim or (ii) one hundred U.S. dollars ($100).

Indemnification

You agree to defend, indemnify and hold harmless TSUCAVA and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your (i) access to or use of the Services, (ii) violation of these Terms, (iii) violation of any law or the rights of a third party, or (iv) negligence or willful misconduct.

Governing Law and Venue

These Terms and any dispute arising from or relating to them or the Services shall be governed by the laws of the State of New York, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Albany County, New York, and you consent to the jurisdiction of such courts.

Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be deemed severable from the remaining provisions and will not affect their validity or enforceability.

Entire Agreement

These Terms constitute the entire agreement between you and TSUCAVA regarding the use of the Services and supersede all prior or contemporaneous understandings, communications or agreements, whether written or oral, regarding the subject matter herein. Additional terms may apply to specific services; those terms will be presented to you at the time you access the service and will be incorporated into these Terms by reference.
